...The last will & testament of James Badgett Sr. deceased was offered to the court for probate, whereupon J. W. Flennikin a subscribing witness theirto made oath that he saw the said James Badgett Sr. sign, seal, and execute said instrument of writing, and heard him pronounce, publish, and declare the same to be his last will and testament and that at the time of signing the same he was of sound mind and memory according to the best
of hisknowlege and belief. Which will is admitted to record and is in the words and figures following (?).

...I James Badgett Sr. of the county of Knox and State of Tennessee being of sound disposing mind and memory do make, ordain, and publish this my last will and testament.

...First I order and desire that all my just debts and financial expences be paid out of my estate and direct that all debts owing to me be collected and applied to that purpose. If the debts owing to me should not be sufficient to pay and satisfy all my just debts and finacial expences then in that event my executors are to sell as much of my personal property as will make up the deficiency.

...Secondly I have heretofore given to my children Abraham Badgett, Samuel Badgett, James Badgett Jr., Lucy Lovell (Dec.) and late wife of Edward Lovell, Elizabeth Pryor wife of William Pryor, Ransom Badgett, and Rebeca Horn wife of Nicholas Horn their portions and shares of my estate and therefore now give and bequeath to each of them or their heirs one dollar.

...Thirdly I give and bequeath to my beloved wife Fanny Badgett all my estate real, personal, and mixed? absolutily without any limitations or restrictions excepting my negro slaves. Namely Rose, Rainy, Nice?, Roil?, Mahala, Rail?, and Brail? and their increaxe I give to my wife Fanny Badgett during her natural life for the use, support, and benefit of my said wife and children that she now has or may hereafter have and hereby will, order, and direct that at the death of my said wife Fanny Badgett the negroes and their increase shall be equally divided amongst all the children that my said wife may then have, share and share alike.

...Lastly I hereby nominate and appoint my beloved wife Fanny Badgett my executrix and my friends Samuel Flannigan and Jacob F. Fout my executors of this my last will and testament and I do hereby revoke, annul, and declare void all other and former wills and testaments by me made. In testamony whereof I have hereunto set my hand and seal this 15th day of March 1833.
