364. Garret* CORNELISON1234,1431,1432,1433 was born on 17 Nov 1696.1434 He owned 92 acre homestead on 13 Dec 1762 in , Loudon Co., VA.1435 "This indenture made the thirteenth day of December in the year of our Lord one thousand seven hundred and sixty two between Francis Hague of the County of Loudon and Colony of Virginia and Jane his wife of the one part and Garrett Cornelius of the said county of the other part, WITTNESSETH that the said Francis Hague for and in consideration of the sum of five Shillings Sterling to him in hand paid the Receipt whereof is hereby acknowledged HATH BARGAINED & sold and by these presents doth bargain and sell unto the said Garrett Cornelus all and singular that tract and parcel of land situate lying and being in the said County of Loudoun and in the Killastem Mountain and bounded as followeth wit;

Beginning at a stake between a marked white and black oak in a valley near the place called Aruen's Folly in a line of John Batts extending thence with Batt's line a 12W 135 poles then N 876 177 poles to a white oak corner to James Clemons than with his lines N 35 30W 15 poles to a small white oak then S 80 W 119 poles to a stake near a marked black oak on a hill then N 15 E 48 poles to a chestnut tree by a spring branch the said Clemons Beginning tree thence S 87 W to a pole to the first station containing ninety two acres of land together with all houses building orchards water ways watercourses hereditaments and appurtenances whatever thereto belonging
anywise, TO HAVE AND TO HOLD the same with the appurtenances unto the said Garrett Cornelius his executors administrators & assigns from the date thereof for and during the term of one whole year from thence next ensuing fully to be compleat & ended by yielding and paying therefor the rent of one ear of Indian corn on the first day of November.

The same be demanded to the intent that by Virtue hereof and of the statute for transferring uses into possession of the said premises and be enabled to take a grant of the Reversion of Inheritance there of to him his heirs and assigns forever in WITTNESSES whereof the said Francis Hague and Jane his wife hath hereunto set their hands and seals the day and year first above written.

The next day, December 14, 1762, the indenture was "proved" by the oaths of three "wittnesses", one of whom was James Clemons, the neighbor who shared one boundary line. The deed was recorded by Chas. Binns, Cl Ct.

The ritual of the payment of one ear of Indian corn and the reference to the statute for transferring uses into possession indicate the Colony of Virginia may have had some sort of Homestead Law that required the owner to live on the land for one year to qualify for ownership.
